These Terms and Conditions govern your use of the mitigateco.com website and the services provided by Colorado Wildfire Mitigation Ltd. ("CWM," "we," "us"). By using this website, submitting a request, or accepting a quote from us, you agree to these terms.

1. Wildfire Risk - No Guarantee

Wildfire mitigation reduces risk. It does not eliminate it. No treatment, product, installation or plan can guarantee that a structure will survive a wildfire. Nothing on this website, in any assessment we provide, or in any work we perform is a representation or warranty that a property will not be damaged or destroyed by fire. We are not liable for fire loss.

2. Information on This Website

Content on this site, including guides to insurance requirements, building codes, defensible space standards, grant programs and tax credits, is provided for general information only. Codes, insurance requirements, grant programs and funding availability change frequently and vary by county, jurisdiction and carrier. This information is not legal, insurance, tax or financial advice. Always confirm current requirements with your local jurisdiction, your insurance carrier, or a qualified professional before making decisions.

3. Interactive Tools and Estimators

Any risk checker, funding checker, permit checker, calculator or similar tool on this website produces a general estimate based only on the information you enter. Results are not a professional assessment, a code compliance determination, a permit decision, a funding approval, or a guarantee of any outcome. Only an on-site evaluation by our team, and a decision by the relevant authority or carrier, can determine your actual situation.

4. Insurance and Grant Outcomes

We do not control insurance carrier decisions. Completing recommended mitigation work does not guarantee that a policy will be issued, renewed, reinstated or discounted, or that a wildfire risk score will change. Where we assist with grant or cost-share applications, we do not guarantee that funding will be awarded, approved or reimbursed.

5. Assessments and Inspection Reports

Assessments, risk reports and defensible space inspections reflect visible conditions observed on the date of the site visit. They are advisory. They are not a certification of code compliance unless expressly issued as one, and they do not cover conditions that were concealed, inaccessible, or that changed after the visit.

6. Quotes, Proposals and Service Terms

Work we perform is governed by the Terms and Conditions attached to the quote or proposal you approve, which control over this page in the event of any conflict. Those terms cover scope, fixed pricing, change orders, payment, scheduling, property lines, utilities, warranty and liability. A quote is not a contract until you approve it in writing or pay the deposit.

7. Requests Submitted Through This Site

Submitting a form, booking request or assessment request does not create a contract or reserve a work date. We will contact you to confirm availability, scope and pricing. We may decline any request.

8. Text Messages and Calls

By providing your phone number, you agree that we may contact you by phone and text message about your request, quote, schedule and job. Message and data rates may apply. You can opt out of texts at any time by replying STOP, or by calling us. Opting out of texts does not affect our ability to reach you by phone or email about active work.

9. Photographs

We may photograph and record properties before, during and after work, and use those images in our marketing, including this website, our Google Business Profile and social media. Images are not labeled with a client's name or full street address without permission. Clients may opt out by notifying us in writing before work begins.

10. Intellectual Property

All content on this website, including text, photographs, assessment templates, tools and graphics, is the property of Colorado Wildfire Mitigation Ltd. and may not be copied, reproduced or republished without written permission.

11. Third-Party Links

This site links to county, state, federal and other third-party resources for your convenience. We do not control those sites and are not responsible for their content or accuracy.

12. Limitation of Liability

To the fullest extent permitted by law, Colorado Wildfire Mitigation Ltd. is not liable for any indirect, incidental or consequential damages arising from your use of this website or reliance on its content. Our liability for services performed is limited as set out in the terms attached to your approved quote.

13. Governing Law

These terms are governed by the laws of the State of Colorado. Any dispute will be brought in the Colorado county where the property or our principal place of business is located.

14. Changes

We may update these terms at any time. The version posted on this page is the version in effect.
